Marriage Equality & Racial Justice


Marriage equality for same-sex couples is widely supposed to be in perfect harmony with civil rights projects that aim for racial justice. But is it? On the level of constitutional argument, does the push for marriage equality in the federal courts in any way dovetail with the elimination of race-conscious remedial projects such as affirmative action in higher education?


In a lecture that considers the need for new and different approaches to marriage equality, Professor Spindelman will also preview upcoming oral argument in the Supreme Court inUnited States v. Windsor, a challenge to the Defense of Marriage Act (DOMA), and Hollingsworth v. Perry, a challenge to California's Proposition 8.
